FDA warns Janson Beckett, Andes Natural Skin over false marketing claims

The US Food and Drug Administration (FDA) has issued letter of warnings to the US-based cosmetics manufacturers Janson Beckett and Andes Natural Skin Care, following findings that their products were violating regulation laws through misleading marketing claims.

Janson Beckett was sued, as the FDA found claims, for its ‘Vitamin C&C Facial Serum’ and ‘Vitamin C Ester’ amongst various other products, marketed with claims ‘Vitamin C Ester… boosts protective antioxidant action and helps repair past damage by aiding new collagen production,’ reported cosmeticsdesign.com.

The FDA found the description and marketing of the company’s products to have violated the Act, and that they were not generally recognised among qualified experts as ‘safe and effective and, therefore, identified as new drugs as defined in section 201(p) of the Act [21 U.S.C. § 321(p)].’

According to the agency, the cliams are intended to affect the structure or function of the body, and the products need to be marketed as drugs under the Food, Drug and Cosmetic Act.

On the other hand, the Andes Natural Skin Care was warned by the agency following thereviewe of the company’s website which claims its its ‘BioSkinRepair… helps to prevent and reduce all types of scars, because it orchestrates an orderly repair of damaged skin, scarless healing & enhanced skin regeneration.’

The agency said the products promotionsare voiltaing sections 201(g)(1)(B) and/or 201(g)(1)(C) of the Federal Food, Drug, and Cosmetic Act.

The agency found that the products claims are making them suitable for use in the diagnosis, cure, mitigation, treatment, or prevention of disease and/or are intended to affect the structure or any function of the human body, rendering them drugs and thus violating its act.

Based on the new results, the agency has requested that the cosmetic companies should contact them to convey the specific action they intend to take to ensure that the products comply with the Federal Food Drug and Cosmetic Act within 15 days.
