FHI Brands wins lawsuit filed by Farouk Systems

US-based provider of professional hair care products FHI Brands has won a lawsuit filed by hair products supplier Farouk Systems.

FHI Brands and Farouk Systems both manufacture and sell hair products.

The US District Court for the Southern District of Texas senior judge Nancy F Atlas issued an order dismissing the lawsuit filed by Farouk Systems against the company’s affiliate FHI Heat.

In the ruling, the judge said: "Farouk Systems failed to present evidence that raises a genuine issue of material fact regarding at least one essential element of each of its claims."

In particular, the judge found that FHI Heat did not infringe on Farouk Systems’ copyrights because there was no evidence that it holds valid copyrights to the works in question.

Furthermore, claims of trade dress infringement related to the use of a red and black colour combination were invalid because its use was generic and not consistently used by Farouk Systems.

The judge also stated that FHI Heat did not breach a contract with Farouk Systems because no contract exists between the two companies.

FHI Brands president and CEO Shauky Gulamani said: "We are pleased that the court dismissed this flawed and outrageous lawsuit."

The firm owns FHI Heat, Stylus , Neo Bond, Hair Veil and Daily Beauty brands.
